General Elections March 1972 Barmer

After absolute victory  In Indo-Pak War , Mrs Gandhi , the then PM India  postponed the Census  Operations scheduled from March 11972  and declared General Eections .
Acclaimed as Victorious  Devi Durga by Opposition Leader AB Vajpayee she launched  her election campaign on Garibi Hatao slogan .
Amrit Nahata,  Barner sitting Congress MP MP also of Kissa Kursi film producer fame filed his nomination papers  before me Collector  being  DEO cum RO of Barmer  Constituency .Shri BS Shekhawat filed his nomination as Jan Sangh candidate. 
Jahoor Bux an independent  candidate  after filing his nomination  challenged the identity of  Amrit Nahata who was enrolled  in  Jodhpur  Electoral Register as Amrit Raj.
On the day of scrutiny or a day  earlier  I convened a meeting of all candidates to decide the issue of Shri  Amrit Nahata. Shri Shekhawat who sat in a chair in the second row rose up and whispered  in my ears that he wished to leave for his campaign hence sought leave of absence. 
Jahoor Bux put forward his plea that Amrit Nahata was not the same Amrit Raj who was enrolled in Jodhpur as a voter. Hence his nomination  should  be rejected .He was supported  by his lawyer and a handful of followers. He also stated that if his case was rejected he would  file a writ petition before Hon.High Court. 
After hearing Jahoor  Baksh,s arguments and going  through his plea in application  I wrote out my decision  running in 4-5 pages citing provisions of CPC and Evidence Act as there was  no case law by then .Interestingly, an Evidence  Act provision (section not recalled now) which  stated that some objects and phenomena in life and Nature are self explained like color of leaf or  or a flower and need to be accepted as such.
I concluded  that being sitting  MP he had  filed his nomination accompanied by about 100 supporters and accepted as such by Opposing candidate Shri Shekhawat there was absolutely no doubt  in any one's mind about  his candidature. His  previous election was not challenged  at all.
Probably Shri Jahoor  Baksh's  writ petition was rejected without  admission .
Needless to add Shri  Nahata won his seat again  with a margin  nearly  a lakh of votes.
